User Agreement

1. Agreement to Terms

By accessing or using the Surplus EV Inc. website and services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Use License

Permission is granted to temporarily access the materials (information or software) on Surplus EV's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title.

3. Vehicle Reservations

When you place a reservation for a vehicle:

  • You must pay a refundable reservation fee, shown at checkout
  • This fee will be refunded if you cancel your reservation
  • Reservations are subject to vehicle availability
  • We reserve the right to cancel reservations at our discretion

4. Vehicle Purchase Terms

All vehicle sales are subject to the following conditions:

  • Vehicles are sold "as-is" with no warranties unless otherwise specified
  • Sales are limited to California residents only
  • Buyers must provide valid California driver's license and proof of auto insurance
  • Buyers must complete all required documentation including DMV forms
  • Final payment must be received and cleared before vehicle delivery
  • Accepted payment methods: ACH transfer, wire transfer, or cashier's check (credit/debit cards only accepted for reservation deposits)
  • Purchases of vehicles priced at $50,000 or less may be canceled within 3 days under our 3-Day Return Policy (see Section 5)
  • Delivery or pickup must occur within 14 days of payment

5. 3-Day Return Policy

Every Surplus EV vehicle priced at $50,000 or less is backed by our 3-day return policy, matching the return right in your purchase agreement. Beginning October 1, 2026, California's CARS Act (SB 766) also requires this right for eligible used vehicle purchases.

The cancellation period begins the calendar day after you sign your purchase contract and ends at our close of business on the third day. If the last day falls on a day we are closed, the period extends to the next day we are open.

To cancel, you must return the vehicle to us within the cancellation period during our regular business hours, notify us that you are exercising your 3-day right to cancel, and return any items, documents, or consideration reasonably required to complete the cancellation. The vehicle must not have been driven more than 400 miles since delivery, must be in substantially the same condition as delivered (ordinary wear and tear excepted), and must have no new liens.

We will not charge you for the right to cancel itself. If you do cancel, we may charge a restocking fee of 1.5% of the vehicle price ($200 minimum, $600 maximum) and a mileage fee of $1 per mile for miles driven over 250 miles, up to $150. We will refund all amounts paid, less any applicable fees, within 48 hours after the returned vehicle is received. If your payment method does not result in an immediate verified transfer of funds, the refund may be delayed until 2 business days after your payment is verified, and we will provide documentation showing when verification occurred. If you traded in a vehicle, we will return it to you, or pay you its agreed value if it has already been sold or transferred (you may request proof of that sale or transfer).

Vehicles priced above $50,000 are not eligible, and those purchases are final upon signing. This policy does not limit any other rights or remedies you may have under law. The Return Policy Disclosure provided with your purchase agreement is the governing document.

6. Account Terms

You are responsible for:

  • Maintaining the confidentiality of your account
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use

7. Customer Support Services

We provide customer support through various channels, including a chat service powered by Crisp:

  • Our chat service is available to all users, whether or not they have an account
  • If you are logged into your account, you may choose to share your account information with our support team to receive more personalized assistance
  • Sharing your information is optional and based on your explicit consent
  • Any communication through our customer support channels should be professional and respectful
  • We reserve the right to terminate support conversations that contain abusive language or behavior

8. Pricing and Fees

All prices and fees are subject to the following terms:

  • Vehicle prices are listed in U.S. dollars and exclude taxes and fees
  • California sales tax will be calculated based on your registration address
  • DMV registration fees will be calculated and disclosed before delivery
  • Prices are subject to change without notice until reservation is confirmed
  • We reserve the right to correct pricing errors
  • Additional fees may apply for delivery services

9. Privacy and Data Collection

By using our services, you acknowledge that:

  • We collect and process personal information as described in our Privacy Policy
  • You consent to the collection of identity documents for purchase verification
  • Your information may be shared with government agencies for vehicle registration
  • You have rights under California privacy laws as detailed in our Privacy Policy

10. Disclaimer

The materials on Surplus EV's website are provided on an 'as is' basis. Surplus EV makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

11. Limitations

In no event shall Surplus EV or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Surplus EV's website.

12. Accuracy of Materials

The materials appearing on Surplus EV's website could include technical, typographical, or photographic errors. Surplus EV does not warrant that any of the materials on its website are accurate, complete, or current.

13. Links

Surplus EV has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Surplus EV of the site.

14. Modifications

Surplus EV may revise these terms of service for its website at any time without notice. By using this website, you are agreeing to be bound by the then current version of these terms of service.

15. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of California and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
